This Refund and Cancellation Policy outlines the terms and conditions regarding Cancellations, Refunds, and modifications to Bookings made with Nomadclun LLC (“We,” “Us,”, “Our” or “Nomadclun”). It aims to ensure transparency and clarity for Our customers (“You”, “Your” or “Customer”) while managing expectations. Please read this policy carefully to understand Your rights and obligations before making any Bookings.
Nature of These Terms
Upon making any payment to Nomadclun, a binding contract is formed between you and Nomadclun. This contract establishes the duties and obligations of both parties under these Terms and Conditions (“Terms”).
Nomadclun reserves the right to amend these Terms when reasonably necessary (e.g., in response to changes in applicable laws or regulatory requirements). Amendments will take effect upon publication on Our Website and apply to contracts entered into thereafter.
Definitions
“Refund” refers to the process of returning money paid by the Customer for a Booking or Service, in accordance with the conditions set forth in this Refund Policy.
“Cancellation” refers to the act of terminating a Booking or reservation made with Nomadclun, either by the Customer or by Nomadclun, subject to the conditions of this Refund Policy.
“Booking” refers to the reservation or purchase of services or events offered by Nomadclun LLC, which are subject to these Refund and Cancellation Terms.
“Refund Request” refers to the formal process by which the Customer seeks to recover funds under this policy after a Cancellation or a change in the Booking.
“Refund Eligibility Period” refers to the designated time frame within which the Customer can request a Refund or Cancellation under the terms of this policy.
“Cancellation Fees” refers to any charges that may apply to the Customer when canceling a Booking, as specified under this Refund and Cancellation Policy.
These definitions shall apply specifically to the Refund, Cancellation, and Booking-related terms mentioned in this policy and any associated documents.
Nature of this Terms
As soon as any payment is made, a contract will automatically arise between you and
Nomadclun LLC, giving both parties respective duties and obligations under that contract. These terms and conditions (“Terms”) will form the basis of any contract between you and Nomadclun LLC.
The Nomadclun LLC reserves the right to make reasonable changes to these Terms at any time where such changes are necessary (for instance, in the case of a change in the applicable laws or regulatory requirements). Such changes will take effect when the updated terms and conditions are uploaded to the ‘Nomadclun’ website.
Disclaimer of warranties
Our website is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our website will be uninterrupted or error-free, that defects will be corrected, or that our website or the servers that make it available are free of viruses or other harmful components.
Pricing
Nomaclun LLC reserves the right to change the price of your booking before your booking is confirmed and is not responsible for fluctuations in currency.
Any such changes will be communicated to you. Nomadclun LLC reserves the right to correct pricing errors after confirmation. In the unlikely event of a pricing error, we will notify you of the correct price and you will have the option to pay the correct price or cancel the booking with a full refund.
The default invoice payment currency is in USD($) but you may be able to pay in alternative currencies specified as being available and accepted by Nomadclun LLC on our website from time to time.
The Nomadclun can change the price of any package after you’ve booked, only in certain circumstances:
We will absorb, and you will not be charged for, any increase up to any amount equal to 2% of the price of your travel arrangements (other than costs associated with insurance
premiums and any amendment charges). You will only be charged for any amount over that 2%. If this results in an increase equal to more than 8% of the price of your travel
arrangements, you will have the option of:
changing to another holiday if we are able to offer one (in which case we will refund any price difference if the alternative is of a lower value); or
canceling and receiving a full refund of all monies paid, except for any amendment charges. Should you decide to cancel:
This does not include fluctuations in currency. Should the price of your package go down due to the cost changes mentioned above, then an amount equal to the reduction will be paid to you. We will deduct from this amount our reasonable administrative expenses. Please note that travel arrangements are not always purchased in local currency.
Payments
You will pay Nomadclun LLC the sum specified in the confirmation invoice.
The default invoice payment currency is in USD($). If you choose to pay with GBP(£), CAD($), AUD($) or EUR(€) (or any other currency) the price listed may change depending on fluctuations in exchange rates including the internal exchange rate which Nomadclun may apply in any future payment transactions. For this reason, you are advised to pay in the currency specified in your Invoice if you do not wish to pay any price variations as a result of fluctuations in exchange rates, including the internal exchange rate which Nomadclun may apply in any future payment transactions.
The payment installment plan will vary depending on the event week and destination you have booked. You will be advised of the specific payment plan for your booking prior to issue of the confirmation invoice. For the majority of events the payment installment plan shall be as follows:
a) 10% of the total cost of the booking must be paid immediately upon booking. This will be a non-refundable deposit unless the booking is canceled in accordance.
b) 40% of the total cost of the booking must be paid no later than 30 days after the date on which the booking is made;
c) 100% of the total cost of the booking must be paid no later than 120 days before the event begins (check your booking to see the exact date).
d) For bookings made between 180 - 120 days before the event begins (check your booking to see the exact date), 40% of the total cost of the booking must be paid upon booking. For bookings made less than 120 days before the event begins, 100% of the total cost of the booking must be made upon booking.
e) Automated recurring payment plan – if the automated monthly payment option is selected the revised payment schedule will be presented before acceptance and will be based on the amount remaining to be paid and the number of months pre departure. If this option is selected the cardholder agrees that future payments can be debited from that method of payment on a recurring basis until the balance has been paid. If this recurring schedule is broken for any reason Nomadclun will look to ensure that balances are paid at least in accordance with (a) – (d) in this paragraph.
If you fail to pay an installment by a payment due date Nomadclun LLC reserves the right to cancel the booking and you will not be entitled to a refund of any sums paid.
It is your responsibility to check the payment due dates and ensure that payments have been made in accordance with the payment instalment plan. Any delay in making a payment may result in your booking being canceled by Nomadclun LLC without a refund. If you are likely to be unable to make a payment on time you must contact Nomadclun LLC as soon as possible to request an extension to the relevant payment due date. If such an extension is agreed, Nomadclun LLC will communicate this to you in writing.
If the first payment under paragraph 27 or paragraph 28 is not made on time, the booking will be automatically canceled.
If payments are not made from an account/card in the name of the Booker, Nomadclun
reserves the right to request authorisation from the account holder.
Refunds, cancellations and booking changes
Any payment made towards booking your place on a Nomadclun LLC is non-refundable by Nomadclun LLC. Although circumstances change, any payment received from you is
immediately used to secure your space in the villa and other activities you will participate in during the Nomadclun LLC.
These financial obligations mean that Nomadclun LLC is unfortunately unable to offer a refund in any circumstance.
Should your circumstances change and you have no choice but to cancel your booking, you must inform Nomadclun LLC in writing as soon as possible. Your booking will not be cancelled until Nomadclun LLC receives your notice of cancellation in writing i.e., via email to info@nomadclun.info. Your cancellation will not be confirmed until you have received confirmation in writing from us.
To make any changes to your booking, email info@nomadclun.info. Nomadclun LLC reserves the right to charge an admin fee of +$100 to make any adjustments to a booking.
The following is applicable to all ongoing and upcoming Nomadclun LLC Trips:
Any tickets purchased will be fully refundable for a 24-hour period after the initial purchase date. Any cancellations made after the 24-hour cancellation period will no longer be eligible for a refund or Credit Voucher for the total value of any payments made. If there is a difference in costs i.e., an increase in price between the original trip or date(s) selected by the customer and the new chosen trip or date(s), then Nomadclun LLC reserves the right to charge the customer for this difference in price to make the change. Conversely, if the new trip or date(s) is cheaper than the original trip or date(s) that was booked by the customer, they will lose out on the difference paid and Nomadclun LLC reserves the right to retain those funds in order to successfully make the change. This applies to all trips.
As Nomadclun booking information is prepared well in advance, some minor aspects of your booking (e.g. change of Activities, change of accomodation or minor itinerary amendments due to weather or local restrictions) may have to change closer to the time of your holiday in order to make the booking work and we reserve the right to do so.
If major changes (e.g. significant change of dates or significant change of accommodation) to your package booking are needed, you will be notified as soon as is reasonably possible. In this instance you will be able (except where we are subject to unavoidable and extraordinary circumstances) to either:
a. cancel the booking with a refund of all sums you have paid;
b. choose to accept the changes; or,
c. make an entirely new booking.
You must inform the Nomadclun LLC of your decision within three working days of being informed of the changes made to your booking. If you do not inform Nomadclun LLC, we shall be entitled to cancel your booking and issue a full refund. Where we are subject to unavoidable and extraordinary circumstances, (being a situation beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Such circumstances include but are not limited to, dangerous weather conditions, pandemic, epidemic fire, natural disaster, industrial actions, war, riots, and natural disasters and Insufficient bookings), your rights under these Terms may be different as we will follow any applicable guidance which may allow us to postpone refunds, to offer credit notes and, in some circumstances, to withhold refunds Nomadclun LLC will not be liable for any transportation costs, including flights, in the event of a trip cancellation due to extraordinary circumstances.
Claiming a Refund
In order to successfully claim a Refund, Credit Voucher or Trip/Date change, cancellations must be made within the 24-hour cancellation period of the initial purchase date for applicable trips. Any cancellation(s) made after these timeframes will not be applicable for a full refund, credit voucher or trip/date change.
If a customer has no choice but to cancel, they will lose any sums paid alongside their spot on the trip and also not be entitled to a trip/date change or Credit Voucher for future trips.
Refunds shall be made to the payment card used for the original payment within 30 days after the cancellation has been confirmed.
Cancelation by Us
Nomadclun LLC will strive to avoid cancellations, however, sometimes they are unavoidable and Nomadclun LLC will reserve the right to do so when it sees fit. In this event, Nomadclun LLC will notify you of any cancellations as soon as possible before departure and you will have the choice to:
1) accept the cancellation and altered arrangements,
2) book alternative arrangements from Nomadclun LLC of a similar standard to the original booking if available
Governing Law and Jurisdiction
This policy is governed by the laws of Arizona, USA . Any disputes will fall under the exclusive jurisdiction of the courts in the state of Arizona, USA.

Dispute Resolution
First Before resorting to legal action, both parties agree to resolve disputes through mediation.
If mediation fails, disputes shall be resolved through legal proceedings in accordance with the prevailing laws, under the jurisdiction of the courts in the State of Arizona.
Severability
If any provision of this policy is found invalid or unenforceable, the remaining provisions will remain in full effect.
Indemnification
The customer agrees to indemnify and hold harmless Nomadclun from any claims, losses, damages, or liabilities arising from their actions or omissions regarding the Booking or trip.

The terms and conditions outlined in this Refund Policy are to be read in conjunction with Our other policy documents, including but not limited to Our Disclaimer, Privacy Policy, and Terms of Use. These documents provide additional guidance and stipulations regarding Your relationship with Nomadclun and Our services.
